These Terms and Conditions govern your use of photography services provided by Giggles Play and Portraits (operating under the DBA Adam and Claudia Photography). By engaging with our services, you agree to comply with and be bound by these terms.
1. Agreement
By booking a session with Giggles Play and Portraits (hereafter "the Photographer"), you agree to these Terms and Conditions in their entirety.
2. Booking & Payment
Booking: A session is considered booked once the creative fee is received, and the photographer confirms the appointment.
Payment: Full payment is due before or on the day of the session unless otherwise agreed upon. A non-refundable creative fee may be required at the time of booking.
Prices: All services and pricing posted online are subject to change, but confirmed bookings will be honored at the agreed-upon price.
Session Contract: A session contract will be sent to you breifly following the creative fee payment and agreement of the session date, time and location. The session contract MUST BE SIGNED prior to the date of your session.
3. Cancellation & Rescheduling
Cancellation: If you need to cancel a session, please notify us at least 3 days in advance. Creative fees are non-refundable within 7 days of your session date, but we will work with you to reschedule your session.
Rescheduling: We will accommodate rescheduling requests where possible, but we cannot guarantee availability for any specific date. The Creative fee paid for rescheduled sessions are non-refundable.
4. Session Details & Responsibilities
Location: Sessions will take place at a location agreed upon by both parties. If you wish to change the location, please inform us in advance.
LOCATION FEES: Client is liable for any and all fees incurred at the location of choice, including but not limited to: parking and admission fees , etc. If the photographer is subject to any fees while providing service to the client, those fees will be billed back to the client at the time the client purchases their images.
NON-ACCESS TO LOCATION: If the Client is not allowed access to the location based on their outfit or choice of props, the session cannot be rescheduled for another time. It is the client’s responsibility to check with the location about what the location allows in terms of props or clothing.
Arrival Time: Please arrive on time. Late arrivals may result in a shortened session or forfeited time.
Attire & Props: You are responsible for your attire and any props you wish to bring. We can provide recommendations based on your session type.
5. Purchase, Image Delivery & Copyright
Making a Purchase: A phone appointment will be scheduled at the end of the session in order for the clien to preview their images and choose which images will be purchased. At this point, the client will choose which purchase option they will agree to purchase in order to gain access to specific images.
Monthly Payments: Automatic monthly payments are available as a convenience when purchasing a standard package. If the client opts to make regular payments for their purchase, their images/order will not be processed or delivered until their order is paid in full.
Delivery Time: Images will be delivered within the timeframe specified at the time of booking. Digital files will be provided through a secure online gallery.
Copyright: Giggles Play and Portraits retains copyright over all images produced. If you purchase digital images, You are granted a limited license for personal use only.
Use of Images: The Photographer reserves the right to use images for promotional purposes, including but not limited to social media, websites, and portfolios, unless otherwise agreed upon.
6. Liability
Photographer’s Liability: The Photographer will take every reasonable step to ensure the quality and safety of the session, but is not liable for accidents, injuries, or any other unforeseen events.
Client’s Liability: Clients agree to follow all safety guidelines provided by the Photographer as well as the code of conduct at the location of choice.
7. Client Rights & Responsibilities
Image Selection: Clients will be provided access to an online gallery to view and select images after previewing the images with the photographer during a remote screen-share appointment.
Changes to Images: Any retouching or edits beyond the Photographer’s standard offerings may incur an additional fee.
Conduct: Taking photos with any device, including but not limited to, cell phones, cameras, video cameras, or other devices while the session is in progress is prohibited and the photographer reserves the right to cancel the session at any time (even during the session) without granting a refund of the paid creative fee. Please inform all members of your party of this policy before your session starts. Clients also agree to behave respectfully during the session, and the Photographer reserves the right to terminate the session if inappropriate behavior occurs.
8. Force Majeure
The Photographer is not responsible for delays or failure to fulfill contractual obligations due to circumstances beyond our control, including but not limited to natural disasters, illness, or unforeseen emergencies.
9. Refunds
Due to the nature of the service, Creative Fees, Deposits, and Payments are non-refundable. However, if the Photographer is unable to fulfill the session for any reason where the photographer is at fault, a full refund will be issued.
10. Modifications
We reserve the right to modify these Terms and Conditions at any time. Any changes will be communicated to clients, and continued use of our services after the changes constitutes acceptance of the updated terms.
11. Governing Law
These Terms and Conditions are governed by the laws of the state in which Giggles Play and Portraits operates (currently California), and any disputes will be resolved in the appropriate courts in that jurisdiction.
